Special counsel Robert Mueller has focused on events since the election — not during the campaign — in his conversations with President Trump’s lawyers, Axios reported Monday.
“That suggests a focus on obstruction of justice while in office, rather than collusion with Russia during the campaign,” the report said.
The report said the top two topics that Mueller has expressed interest in so far are the firings of FBI director James Comey and national security adviser Michael Flynn.
President Trump fired Comey last May, under the recommendation of Deputy Attorney General Rod Rosenstein. However, in an interview, Trump said the Russia investigation was also on his mind.
Comey told lawmakers that Trump had asked him to let former National Security Adviser Michael Flynn go — who was under FBI investigation — during a private conversation. The president has denied making any such request
“You cannot charge a president with obstruction of justice for exercising his constitutional power to fire Comey and his constitutional authority to tell the Justice Department who to investigate, who not to investigate,” Harvard Law professor Alan Dershowitz said
( Daily Caller ) Former Attorney General Eric Holder believes special counsel Robert Mueller already has plans to charge President Donald Trump with obstructing justice.
Mueller is holding back on charging Trump until he can make sure he has the president dead-to-rights, Holder, who served under former President Barack Obama, said Friday night on HBO’s “Real Time with Bill Maher.” He has made similar arguments in the past regarding Trump’s behavior.
“I’ve known Bob Mueller for 20, 30 years; my guess is he’s just trying to make the case as good as he possibly can. So, I think that we have to be patient in that regard,” Holder said. He has long-suggested that Trump should be held criminally liable for ousting former FBI Director James Comey during the midst of an investigation into Russian meddling.
“You cannot charge a president with obstruction of justice for exercising his constitutional power to fire Comey and his constitutional authority to tell the Justice Department who to investigate, who not to investigate,” Harvard Law professor Alan Dershowitz said last year.
The topics are largely related to the firings of Flynn and Comey.
The description of topics suggests any interview with Trump could focus substantially on obstruction of justice issues.
(CNN)Special counsel Robert Mueller has provided lawyers for President Donald Trump with a range of topics he wants to ask about as part of ongoing negotiations regarding an interview with the President, sources familiar with the matter tell CNN.
Mueller’s team has also made clear it is seeking a sit-down interview with Trump, according to these sources. The President said Wednesday he is “looking forward” to that interview, subject to the advice of his lawyers.
As the President’s attorneys try to whittle down Mueller’s areas of interest, a source familiar with the matter says the special counsel has obliged by offering a list of topics, including learning more about the President allegedly asking former FBI Director James Comey to drop the investigation into former national security adviser Michael Flynn. Mueller also wants to know about Trump’s reaction to Comey’s May 2017 testimony on Capitol Hill, which reportedly angered the President. Additionally, investigators want to learn more about the President’s outreach to intelligence leaders about the Russia investigation.
The topics are largely related to the firings of Flynn and Comey. The description of topics suggests any interview with Trump could focus substantially on obstruction of justice issues.
It Wasn’t Comey’s Decision to Exonerate Hillary – It Was Obama’s.
Is that not obstruction of justice? The legal definition of obstructing justice is impeding or obstructing those who have duties or powers of administering justice. Is Obama going to be investigated on this? Don’t hold your breath because it’s not going to happen. Obama was ‘untouchable’ when president and it will remain now that he’s ex-president. How about equal protection. Is Trump being treated equally like Obama?
National Review’s Andrew McCarthy believes Barack Obama was the puppet master behind Comey’s decision and lap dog Comey had to obey the master.
Let’s think about what else was going on in April 2016. I’ve written about it a number of times over the last year-plus, such as in a column a few months back: On April 10, 2016, President Obama publicly stated that Hillary Clinton had shown “carelessness” in using a private e-mail server to handle classified information, but he insisted that she had not intended to endanger national security (which is not an element of the [criminal statutes relevant to her e-mail scandal]). The president acknowledged that classified information had been transmitted via Secretary Clinton’s server, but he suggested that, in the greater scheme of things, its importance had been vastly overstated. This is precisely the reasoning that Comey relied on in ultimately absolving Clinton, as I recounted in the same column: On July 5, 2016, FBI director James Comey publicly stated that Clinton had been “extremely careless” in using a private email server to handle classified information, but he insisted that she had not intended to endanger national security (which is not an element of the relevant criminal statute).
The director acknowledged that classified information had been transmitted via Secretary Clinton’s server, but he suggested that, in the greater scheme of things, it was just a small percentage of the emails involved. Obama’s April statements are the significant ones. They told us how this was going to go. The rest is just details. In his April 10 comments, Obama made the obvious explicit: He did not want the certain Democratic nominee, the candidate he was backing to succeed him, to be indicted. Conveniently, his remarks (inevitably echoed by Comey) did not mention that an intent to endanger national security was not an element of the criminal offenses Clinton was suspected of committing – in classic Obama fashion, he was urging her innocence of a strawman crime while dodging any discussion of the crimes she had actually committed.
As we also now know – but as Obama knew at the time – the president himself had communicated with Clinton over her non-secure, private communications system, using an alias. The Obama administration refused to disclose these several e-mail exchanges because they undoubtedly involve classified conversations between the president and his secretary of state. It would not have been possible to prosecute Mrs. Clinton for mishandling classified information without its being clear that President Obama had engaged in the same conduct. The administration was never, ever going to allow that to happen.
Always rogue! President Donald Trump took to Twitter Wednesday morning, blasting the witch hunt from the left this time the using ‘obstruction of justice’ narrative after failed phony story of Russia collusion . Trump also question why Hillary Clinton’s conduct during the probe of her private email server was not under more scrutiny, and why the Clintons family and Democrats dealings with Russia are not looked at.
They made up a phony collusion with the Russians story, found zero proof, so now they go for obstruction of justice on the phony story. Nice.
You are witnessing the single greatest WITCH HUNT in American political history – led by some very bad and conflicted people! #MAGA
Why is that Hillary Clintons family and Dems dealings with Russia are not looked at, but my non-dealings are?
Crooked H destroyed phones w/ hammer, ‘bleached’ emails, & had husband meet w/AG days before she was cleared- & they talk about obstruction?
They made up a phony collusion with the Russians story, found zero proof, so now they go for obstruction of justice on the phony story. Nice
Famous for his “F**k Flynn, and then we f**k Trump”, acting FBI director Andrew McCabe is allegedly the ringleader behind Trump’s obstruction of justice probe, colluding with Special counsel Robert Mueller and leaker former FBI Director James Comey . The left reluctantly dumped the Russian hoax and but now fixate on obstruction. These three are just the visible puppets, the real question we need to ask who are the invisible masters orchestrating the sinister plot to bring down the president.
“Russia” special counsel Robert Mueller has formed a political team with his friend, fired FBI director James Comey, and the current FBI director Andrew McCabe to work together against President Donald Trump. But Mueller and Comey are not the ringleaders. Surprisingly, it’s McCabe.
An inside source told Big League Politics that McCabe is “running the show,” and “he’s the key.”
“Mueller and McCabe are assembling a better political operation than Hillary had in the campaign. The trio of Mueller/McCabe and Comey are all creatures of the swamp,” the source explained. “Any Republican who thinks this isn’t a political operation and isn’t geared toward impacting 2018 and beyond is absolutely nuts.”
“I think McCabe is the most politically savvy given how he navigated the controversy with his wife’s campaign donations and the Clinton investigation,” the source continued.
McCabe took over when Comey got fired and quickly set up the team’s power play. McCabe said that Comey did not get fired from the FBI for performance issues. That sets up the premise for a potential obstruction of justice move by the McCabe-Mueller-Comey trio.
